Texas 11th Court of Appeals writes, “the fact that the owners of these homes choose to utilize a small portion of the attic space in the homes for use has no effect on the other property owners view of the waterfront.” This statement is wrong! Carl Williford’s two-story blocks Morton’s view of the lake. When the judges state “small portion of the attic space in the homes” does that mean less than 3000 sq ft? All that means is the 11th Court of Appeals knows without a doubt these homes have a second story in them which violates the contract Phyllis Morton purchased her house under. Because the State of Texas is short of funds for the schoolchildren, I am surprised that the people in the legal profession would conspire to commit property tax fraud.
